This issue became evident during the comment by Prosecutor Karim Khan on October 29, 2023, during his visit to Cairo, where he condemned the October 7 attack and the “hatred and cruelty” that “motivated” it, considering it the primary cause of violence. The “Orient 21” site considered this as presenting a highly biased approach, where the actions of “Hamas” seem already judged, the investigation appears to favor Israeli victims first, and the prosecutor supports a state that, like the United States, has not ratified the Rome Statute. Recent news reports published by a famous French newspaper revealed a secret campaign aimed at undermining the efforts of the International Criminal Court (ICC) and its Prosecutor Karim Khan in pursuing war crimes cases against Israeli leaders, including Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Galant. The details reveal a series of failures and breaches within the court that have impeded the course of justice. The United States also imposed sanctions on Khan and his family last February, and in June, the sanctions extended to four court judges who approved arrest warrants. In July, legal advisor Reed Rubinstein warned that “all options” are open unless the arrest warrants and investigations into alleged Israeli war crimes are dropped. The United States also imposed sanctions on Francesca Albanese, the UN Special Rapporteur on Human Rights in the Palestinian Territories, after her report revealed Western companies’ involvement in supporting Israeli violations. In the same context, on July 16, 2025, an Israeli request submitted on May 9 sought to cancel the arrest warrants against Netanyahu and Galant, asserting that its jurisdiction includes the occupied Palestinian territories, and that Israel has not provided sufficient justification to suspend investigations. It is noted that the criminal court acknowledged its territorial jurisdiction over the Palestinian territories in February 2021 and opened an official investigation in March of the same year, which announced the inclusion of crimes committed by all parties, including Israeli crimes in Gaza and the West Bank.
