UAE Court Sets New Liability Rules for Plastic Surgeons

The UAE’s Federal Supreme Court has introduced a new rule regarding the accountability of plastic surgeons.

This ruling specifies that cosmetic surgeries, being non-urgent medical procedures, hold doctors accountable for any negligence in their medical practice.

This decision follows an incident involving a woman’s death due to a doctor’s failure to provide the highest standard of care in a body reshaping procedure. The doctor strayed from established medical principles and standards for such surgeries.

According to the new rule, surgeons must avoid performing surgeries where the risks outweigh the benefits, even with the patient’s consent.

Doctors are considered negligent if they employ treatment methods that introduce risks disproportionate to the patient’s intended outcomes, unless there’s no direct link between the action and the harm caused.

This ruling was made by the Administrative Chamber of the court, led by Judge Mohammed Abdulrahman Al Jarrah, with Judges Dawood Ibrahim Abu Al Shawareb and Dr. Hassan Mohammed Hassan Hind, during its session on September 1 in Appeal No. 722 of 2025 Administrative.

The court emphasized that a plastic surgeon must achieve the desired outcome of cosmetic surgery while ensuring the highest level of patient care.

It was further clarified that plastic surgeons must provide more diligent care than other doctors, as the objective is to correct physical imperfections rather than to save a patient from life-threatening danger.
